h1房地产抵押典当合同h1pnbsppp当户出典人nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsp以下称甲方pp住所地址nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsppp机构代码号身份证号码nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsp联系电话nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsppp典当行抵押权人nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsp典当有限公司以下称乙方pp住所地nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsppp企业代码证号nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsp联系电话nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsppp担保方抵押人nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsp以下称丙方pp住所地址nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsppp机构代码号身份证号码nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsp联系电话nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspppnbsppp甲方因资金周转需要向乙方申请抵押典当丙方以其房屋作抵押担保根据我国《合同法》《担保法》和《典当管理办法》的有关规定双方在平等自愿的基础上经协商一致特订立本合同以兹共同遵守ppnbsppp第一条nbsp抵押房屋情况pp抵押房屋位于nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsp小区nbspnbspnbspnbspnbsp栋nbspnbspnbspnbspnbsp单元nbspnbspnbspnbspnbsp层nbspnbspnbspnbspnbsp号房屋所有权证号nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsp建筑面积nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsp平方米估价为nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsp元pp第二条nbsp当金数额pp当金数额为人民币nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsp元整__nbspnbspnbspnbspnbsp_元第三条nbsp典当期限pp1典当期限自nbspnbspnbspnbspnbspnbsp年nbspnbspnbspnbspnbsp月nbspnbspnbspnbspnbsp日起至nbspnbspnbspnbspnbspnbsp年nbspnbspnbspnbspnbsp月nbspnbspnbspnbspnbsppp日止共计nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsp天当期不足5天的按5天计算pp2本合同记载的典当金额发放日期到期日期与当票不一致时以当票记载为准当票为本合同的主要组成部分与本合同具有同等法律效力pp第四条nbsp综合费用当金利率pp1综合费用为月________‰在发放当金时一次性扣收提前赎当不返还预扣的综合费用pp2当金利率为月________‰于签订本合同的每个月期满的对应日支付不足一月的在赎当或续当时交纳提前赎当的利息按实际用款天数计算当期不足5天的按5天计算pp第五条nbsp乙方的权利和义务pp1乙方有权了解甲方的生产经营财务活动产品物资库存和典当使用情况有权要求甲方提供所需的证照件及相关资料pp2甲方出现包括但不限于本合同第六条第3456项所列的足以影响乙方权益的行为或情形乙方有权停止发放当金或提前收回当金本息pp3典当期限或续当期限届满后甲方应在5日内赎当逾期不赎当也不续当即形成绝当如形成绝当乙方有权按《典当管理办法》的有关规定委托拍卖行进行公开拍卖或由乙方自行出售所得款项用以偿还拍卖费用当金本金综合服务费及其他相关费用剩余部分退还甲方不足部分向甲方追索pp4乙方承诺合同生效后一日内将当金给付甲方pp5甲方赎当完毕乙方应及时返还当物及有关单据pp第六条nbsp甲方的权利和义务pp1有权按照本合同约定取得和使用当金pp2按时归还当金如不能按时归还当金时须提前nbspnbspnbspnbspnbspnbspnbsp天与乙方协商续当事宜办理续当手续的同时交纳续当期的综合服务费pp3甲方实施承包租赁股份制改造联营合并兼并分立合资资产转让买卖申请停业整顿申请解散申请破产以及其他足以引起本合同债权债务关系变化或影响乙方债权实现的行为应提前书面通知乙方并经乙方同意同时落实债务清偿责任或提前清偿债务否则不得实施上述行为pp4甲方发生除前项所述行为之外对其履行本合同项下还款义务产生重大不利影响的任何其他情形如停产歇业注销登记被吊销营业执照法定代表人或主要负责人从事违法活动涉及重大诉讼仲裁生产经营出现严重困难财务状况恶化等均应立即书面通知乙方并落实乙方认可的债权保全措施pp5甲方为他人债务提供保证或以其主要财产向第三人抵押质押可能影响其偿还本合同项下当金能力的应当提前书面通知乙方并征得乙方同意pp6若抵押物出现损毁破坏等减值现象时甲方必须采取措施恢复抵押物的价值如不能及时恢复价值则应提供乙方认可的其他抵押物或担保措施pp7甲方如出现变更营业执照及其所载事项时应及时书面通知乙方pp8甲方承担本合同项下抵押房产有关的一切费用包括评估费抵押登记费公证费保险费等pp第七条nbsp丙方的权利义务pp1丙方所提供的所有证件文件和凭证必须真实合法有效房屋产权无任何经济纠纷无任何权利瑕疵未设定抵押如发生不实或欺骗行为由丙方承担全部相关的法律责任并由丙方承担乙方所有的损失pp2丙方抵押担保范围包括当金利息综合费罚息违约金损害赔偿金以及诉讼费财产保全费律师费抵押物处置费过户费等处分抵押房地产的费用及可能产生的乙方代垫费用和其他费用本合同有约定具体数额的按照约定没有约定的依照相关单位出据给乙方的收款发票额为准pp3丙方确须出租抵押房地产的应事先征得乙方的书面同意并将抵押的事实书面告知承租人将租赁合同交乙方备案同时在与承租人签订的租赁合同中约定出租人即本合同规定的甲方因未履行本合同而被乙方行使抵押权实现时承租人应在乙方发出通知之日起10日内迁离该房地产并将租赁合同交乙方备案提交给乙方备案的内容须与房地产交易中心登记备案的内容相一致丙方不得改变合同内容包括延长租赁期限和其他形式给他人使用由此产生的一切后果由丙方和承租人及使用人共同承担pp第八条nbsp抵押物的保险pp1甲方须在乙方指定的时间内到nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsp保险公司并按甲方指定的保险种类为该抵押物购买保险投保金额不得少于重新购置该抵押物的全部金额保险的赔偿范围应包括该抵押物遭受自然灾害及其他意外事故所导致的破坏损毁抵押期限内甲方不得以任何理由中断或撤销上述保险否则甲方须无条件赔偿乙方因此所受的一切损失如甲方不履行还款的义务抵押人应继续购买保险直至本合同项下当金本息全部还清为止pp2甲方须在保险手续办理完毕五日内将保险单正本交由乙方保管保险单的第一受益人须为乙方保险单不得附有任何损害或影响乙方权益的限制条件或任何不负责赔偿的条款pp3甲方不可撤销的授权委托乙方为其上述保险事项的代表人接受或支配保险赔偿金将保险赔偿金用于修缮该抵押物的损坏部分或清偿本合同项下甲方所欠乙方的所有款项pp4甲方如违反上述保险条款乙方可依照本合同之保险条款的规定代表购买保险所有费用均由甲方支付pp5抵押期间该抵押物发生保险责任以外的损毁甲方应就受损毁部分及时提供新的担保并办理相应的手续pp第九条nbsp违约责任pp1乙方未按本合同约定按期足额向甲方发放当金视情况以适当方式补偿甲方损失pp2甲方未按照本合同约定期限归还当金逾期5日即形成绝当乙方有权按照约定处理绝当物品pp3甲方违反本合同项下义务乙方有权要求甲方限期纠正违约行为有权宣布本合同立即到期或采取相应资产保全措施pp4乙方因实现本合同债权而发生的诉讼费律师代理费评估费拍卖费交易过户手续费等一切费用由甲方承担pp5丙方应对该房产拥有完整的所有权如该房产为共有财产则须共有人已签字同意该抵押房产典当贷款因抵押房产存在权属共有争议引起的一切法律责任均由丙方承担乙方并可要求甲方支付当金及利息总额万分之五日的违约金pp第十条nbsp赎当pp1甲方在本合同期满赎当时应当偿还当金及利息pp2甲方可提前赎当逾期赎当的甲方除偿还当金本息外还应按逾期天数和本合同第四条约定的比例支付逾期限利息和综合费用并每日按当金数额的5‰增收罚息pp第十一条nbsp续当pp1如果甲方因特殊原因不能按期偿还当金必须在合同期限届满前五日内向甲方申请办理续当经甲方同意后方可办理续当手续办理续当手续时乙方应付清前期利息和续当综合费用逾期或付清前期利息和续当综合费用不予续当续当费率在首次典当费率的基础上增加________pp2续当时应签订续当凭证本合同之补充本合同继续有效pp第十二条nbsp绝当pp1典当期满或没有在五日内办理续当手续也不赎当的即为绝当pp2依本合同第一条估价金额绝当物品估价不足3万元的由乙方自行变卖或者折价处理损溢自负绝当物品估价超过3万元的由乙方委托拍卖行公开拍卖所得收入由乙p
