h1房屋租赁合同h1p合同编号pp本合同双方当事人pp出租方甲方pp承租方乙方pp根据相关国家法律法规和本市规定甲乙双方在自愿平等互利的基础上经协商pp一致就甲方将其合法拥有的房屋出租给乙方乙方承担使用甲方房屋事宜订立本合同pp一房屋的座落面积及装修设施pp1-1甲方将其合法拥有的坐落在nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsp出租pp给乙方使用pp1-2甲方出租给乙方使用的该房屋建筑面积共nbspnbspnbspnbspnbspnbspnbspnbspnbspnbsp平方米pp1-3该房屋的现有装修及设施状况由双方在合同附件一中加以列明除双方另有有约定外该附件作为甲方按本合同约定交付乙方使用和乙方在本合同租赁期满交还该房屋时的验收依据pp二租赁用途pp2-1本合同签订前甲方已向乙方出示了该房屋的产权证明pp2-2乙方向甲方承诺租赁该房屋仅作为nbspnbspnbspnbspnbspnbspnbsp使用常住人数nbspnbspnbspnbspnbspnbsp人pp2-3在租赁期限内未事前征得甲方的书面同意乙方不得擅自改变给房屋使用用途及pp常住人数乙方也不得擅自更改房屋内部设施格局如甲方发现有合租或群租现象出pp现甲方有权终止本合同及收回房屋并收缴押金作为赔偿金pp三租赁期限pp3-1该房屋租赁期共nbspnbspnbspnbspnbsp个月自二零nbspnbspnbspnbsp年nbspnbsp月nbspnbsp日起至二零nbspnbspnbspnbsp年nbspnbspnbsp月nbspnbsp日止pp3-2租赁期满甲方有权收回全部出租房屋乙方应如期交还乙方如要求续租则必pp须在租赁期满前的一个月向甲方提出书面意向经甲方同意后重新签订租赁合同pp四租金及支付方式pp4-1该房屋每月租金总计为人民币nbspnbspnbspnbspnbspnbspnbspnbsp元不含税大写nbspnbsp万nbspnbsp仟nbspnbsp佰nbspnbsp拾ppnbspnbsp元整pp4-2该房屋租金支付方式如下nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsppp乙方如逾期支付租金每逾期一天则乙方须按月租金的03向甲方支付滞纳金逾期十天则甲方有权终止本合同自行收回房屋甲方将根据乙方实际居住天数计算租金pp五其他费用押金及佣金pp5-1乙方在租赁期限内使用的水电气有线电视费物业管理费由乙方按照有关规定自行负担pp5-2甲方于签约时收取乙方押金nbspnbspnbspnbspnbspnbspnbsp元该押金作为房屋装潢附属设施家电的担保租赁期满后如乙方使用没有造成房屋或设施的损坏则甲方全额退还该押金pp六房屋修缮责任pp6-1在租赁期限内甲方应保证出租房屋的使用安全乙方应爱护并合理使用其所承租的房屋及其附属设施如因乙方使用不当造成房屋或设施损坏的乙方应立即负责修复或予以经济赔偿pp6-2除房屋内已有装修和设施外乙方如要求重新装修或变更原有设施的应事先征得甲方的书面同意租赁期满所以赋予房屋的装修按双方约定处理没有约定的依据相关法律规定处理pp6-3该房屋的维修责任出双方在本合同和本合同补充条款中约定的外均由甲方负责pp如甲方不修缮时乙方可以代甲方修缮并可以用修缮费用票据抵消租金pp6-4甲方维修房屋及其附属设施应提前七天书面通知乙方乙方应积极协助和配合因乙方阻挠甲方进行维修而产生的后果则概由乙方负责pp6-5如因不可抗力原因导致房屋损坏或造成乙方损失的双方互不承担责任pp七出租人及承租人变更pp7-1租赁期内甲方如将此房产所有权转移给第三人应提前三个月书面通知乙方房屋所有权转移给第三个人后该第三人即成为本合同的当然甲方享有原甲方的权利承担原甲方的义务pp7-2除甲乙双方在本合同补充条款中另有约定外乙方在租赁期限内须事先征得甲方的书面同意方可将承担的该房屋部分或全部转租给第三人pp7-3乙方转租给房屋订立的转租合同应符合以下规定pp1转租合同的终止日期不得超过本合同规定的终止日期pp2转租期间乙方除可享有并承担转租合同规定的权利和义务外还应该继续履行本合同规定的义务pp3转租期间本合同发生变更解除或终止时转租合同也应随之相应变更解除或终止pp八变更和解除本合同的条件pp8-1在租赁期限内非下列情况之一的不得变更或者解除本合同pp1甲方或者乙方因有特殊原因经双方协商一致同意甲方提前收回或乙方提前退交部分或者全部该房屋的pp2因出现非甲方能及的情况使该房屋的设施或水或电或气等正常供应中断且中断期一次超过七天乙方认为严重影响房屋的正常使用的pp3因不可抗力的因素致使该房屋及其附属设施损坏本合同不能继续履行的pp4在租赁期间该房屋经市或区县政府有关部门批准动迁或出现因法律法规禁止的非甲方责任的其他情况pp8-2变更或解除本合同的要求变更或解除本合同的一方应主动向另一方提出且以本合同8-1条第234款变更或解除合同的甲乙双方不承担责任pp九乙方的责任pp9-1在租赁期内乙方有下列行为之一的甲方有权终止本合同收回该房屋由此而造成甲方损失的乙方应予以赔偿pp1未经甲方书面同意擅自将该房屋转租转借他人使用的pp2未经甲方书面同意擅自拆改变动房屋结构或损坏房屋的pp3擅自改变合同规定的租赁用途或利用该房屋进行违法活动的pp4拖欠租金累计十天以上的pp9-2在租赁期限内乙方逾期交付水电气费每逾期一天则应按上诉费用的03支付滞纳金逾期达两个月以上的甲方有采取停止供应或使用的权利因此造成的一切后果由乙方自行承担pp9-3在租赁期限内乙方未经甲方同意中途擅自退租的乙方应按月租金的两倍向甲方支付违约金若支付的违约金不足抵付甲方损失的乙方还应负责赔偿pp9-4租赁期满乙方应如期交还该房屋如乙方逾期归还则每逾期一天应向甲方支付原日租金的两倍的违约金逾期十天的则甲方有权依约自行收回房屋pp9-5租赁期满或本合同解除终止后乙方必须在两日内将其物件全部搬出如仍有余物在未取得甲方谅解下均视为乙方放弃所有权任由甲方处理pp十甲方的责任pp10-1甲方未按本合同约定的时间交付给房屋供乙方使用的每逾期一天甲方应按日租金的两倍向乙方支付违约金逾期七天则是甲方不履行本合同甲方应按月租金的两倍向乙方支付违约金pp10-2在租赁期限内甲方因非本合同第四条第一款第九条第1款规定的情况擅自解除本合同提前收回该房屋的甲方应按月租金的两倍向乙方支付违约金若支付的违约金不足抵付乙方损失的甲方还应负责赔偿pp10-3乙方无论任何原因退租则甲方将根据乙方实际居住天数计算租金并将剩余租金如有返还如因乙方违约甲方有权将剩余租金如有优先抵作违约金滞纳金违约金和滞纳金按本合同相关条款执行pp10-4甲方未按时提供其在本合同附件一种所承诺的设施或者设施在甲乙双方交接时无法正常使用则每迟延一天甲方选月租金的03向乙方支付违约金pp十一其他条款pp11-1本合同未尽事宜经甲乙双方协商一致可订立补充条款补充条款及附件均为本合同不可分割的一部分与本合同具有同等效力pp11-2甲乙双方在签署本合同时具有完全民事行为能力对各自的权利义务责任清楚明白对本合同条款含义认识一致pp11-3甲乙双方在履行本合同过程中若发生争议应协商解决协商不成时向该房屋所在地区的人民法院起诉pp11-4本合同正本连同附件一式两份由甲乙双方各执一份均具有同等效力自甲乙双方签字之日起生效pp十二补充条款pp一承租期间非人为损坏电器由甲方承担小件易耗品灯泡等及简单维修由乙方自行解决nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsppp二承租期间乙方需安全使用水电气等设施因水电气未关造成漏水等事故产生的费用及维修赔偿由乙方承担nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsppp三由于房屋为全实木地板铺装乙方如有大面积损坏等后期维修赔偿由乙方承担nbspnbsppp四承租期间若小区集体安装诸如天然气之类的房屋附属公共设施则安装费用由甲方承担使用费用由乙方承担nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspppnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspppnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsppp出租方甲方nbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbspnbsp承租方乙方pp身份
