orcFortherequirementsoflawsandotherstatutorybodies11LiabilityandObligation111乙方应依据本协议条款和履行协议责任和义务111PartyBshallfulfiltheliabilitiesandobligationsofagreementaccordingtotheprovisionsofagreementandtheconditionsofwarehousingandlogisticsservices112乙方将对其在根据协议为甲方提供过程中的各种行为疏忽欺诈懈怠或在进行货运和或仓储和或集装箱装箱和或交付甲方货物等一切按本协议附录1中所详述的操作或在按本协议提供的过程中引起的各种损失包括但不限于成本支出和律师费等如罚金诉讼法律程序损失债务索赔损害独自承担责任并确保甲方及其相关单位和他们的董事管理人员其他员工和代理不会因此承担任何责任112PartyBshalltaketheliabilitiesindependentlyforallactsduringprovidingwarehousingandlogisticsservicesforPartyAaccordingtoagreementsuchasnegligencefraudslackoralloperationsdetailedinAnnex1suchasfreightstoragecontainerspackingordeliveryofgoodstoPartyAandalllossescausedduringprovidingtheservicesincludingbutnotlimitedtocostsSCF4010Ae06expensesandattorneysfeessuchasfinelitigationlegalproceedingslossesdebtsclaimsanddamagesandensurePartyAandtheirrelatedunitsaswellastheirdirectorsmanagersagentsandotheremployeestobearnoresponsibilityforthese113以下情况下乙方没有责任但乙方应在可能的情况下尽力协助甲方对有关单位和个人的索赔a由直接与甲方有契约关系的第三方如起重公司或仓库人员在向甲方提供或的一部分内容的过程中的作为和不作为b由甲方或其书面委托的人员除乙方外的作为或不作为c非乙方负责的包装或唛头标签和编号的标记有误或不足d由甲方或其书面指定人员操作装卸堆放货物以及e非乙方的故意或过失引起的火灾113UnderthefollowingcircumstancesPartyBhasnoresponsibilitybutPartyBshallassistPartyAtoclaimtorelevantunitsandindividualsifpossibleaTheactsandomissionsofthethirdpartysuchasliftingcompanyorwarehousestaffhavingdirectcontractualrelationshipwithPartyAduringprovidingthewarehousingandlogisticsservicesorapartofwarehousingandlogisticsservicestoPartyAbTheactsandomissionsofthepersonnelexceptPartyBentrustedbyPartyAorinwrittencIncorrectorinsufficientofthepackageormarklabelandtagofnumberthatdTheoperationloadingandunloadingpackingofgoodsofthepersonneldesignatedbyPartyAorinwritingandeThefiresarenotcausedbyPartyBintentionallyornegligently12INSURANCE121乙方承诺已对在运输集装箱装箱过程中发生的任何可能的风险购买了相应的保险且乙方对在本协议项下服务内容的操作过程中因一切可归咎于乙方的原因而造成的损失承担全部责任121PartyBpromisesthattheyhaveboughttherelatedinsuranceforanypossibleriskintransportcontainerpackingintheprocessofpackingandPartyBwillbearfullresponsibilitiesforalllossescausedbyPartyBintheprocessofoperationofservicesundertheagreement122为保持产品的最佳仓储乙方承诺在任何时候对在仓储过程中发生的风险购买了５万元以下的保险甲方已经为所存放的物品投保财产险免赔额为人民币五万元整但由于乙方的责任而造成甲方在仓库内所存放物的损失乙方应该承担全部责任122InordertokeeptheproductsinthebeststoragePartyBpromisesthatatanytimetheywillbuyaninsurancenotmorethanRMB50000YuanfortheriskinstoragePartyAhasinsuredpropertyinsuranceforthestoredgoodsandthedeductibleamountisRMB50000YuanasawholebuttheywilltakefullresponsibilityforthelossesofPartyAsgoodsstoredinwarehousebecauseoftheresponsibilityofPartyB13TerminationConditions131在不损害当事方享有的其他权利的前提下如任何一方在任何时候出现下述情况131Withoutprejudicetotheenj
